Penegakan Hukum terhadap Geng Motor di Kabupaten Asahan
Abstract
Abstract
The phenomenon of motorcycle gangs in Asahan Regency has become a social problem that causes public unrest and has the potential to disrupt public order. Crimes committed, such as assault, vandalism, and theft, indicate an escalation of criminal behavior among motorcycle gang members. This study aims to analyze the law enforcement process against motorcycle gangs in Asahan Regency, covering the stages of investigation, prosecution, and sentencing, as well as identifying obstacles faced by law enforcement officers. This research uses an empirical method with a juridical-sociological approach. Data were obtained through interviews with police officers, public prosecutors, judges, and community members, as well as document studies of motorcycle gang case files handled in Asahan Regency. The data were analyzed qualitatively to provide a factual description of the implementation of law enforcement. The results show that law enforcement against motorcycle gangs has been carried out in accordance with the provisions of the Indonesian Criminal Code (KUHP) and related legislation. However, there are still obstacles, including limited resources of law enforcement officers, lack of community participation in providing information, and social environmental factors that encourage the formation of motorcycle gangs. Countermeasures are carried out through repressive actions such as arrest and prosecution of perpetrators, as well as preventive actions through patrols, legal counseling, and youth development programs. The conclusion of this study is that law enforcement against motorcycle gangs in Asahan Regency has been implemented, but its effectiveness needs to be improved through synergy between law enforcement officers, local government, and the community, along with strengthening prevention programs to cut off the recruitment chain of motorcycle gang members.
